Acceptance of these terms

This website at www.afterkelas.com is operated by Core Consult Resources (SA0535328-D), a business registered in Malaysia and trading as Afterkelas. In these terms, "we", "us" and "our" mean Core Consult Resources, and "you" means the person using the site.

By accessing, browsing or submitting an enquiry through this website, you agree to be bound by these terms and by our Privacy Policy, which forms part of them. If you do not agree, you must stop using the site.

What these terms cover

These terms govern your use of this marketing website: the pages on it, the enquiry forms, and the material we publish here.

Who may use this site

You may browse this website at any age. You may submit an enquiry only if you are at least 18 years old and legally able to enter into a contract.

If you are under 18, ask a parent or legal guardian to make the enquiry for you, or to make it with you. By submitting an enquiry about a student under 18, you confirm that you are that student's parent or legal guardian, or that you have their permission to give us the student's details.

What an enquiry does and does not do

An enquiry submitted through this website is a request for information. It is an invitation for us to contact you, not an offer or a booking.

• It does not reserve a place in a class or a slot with a tutor
• It does not commit either of us to a contract
• It does not oblige us to accept the student, and we may decline an enquiry without giving a reason

A class is confirmed only when we say so expressly, after the details, the schedule and the fee are agreed. We aim to reply to every genuine enquiry, usually on WhatsApp, but we do not guarantee a response time.

You agree that the information you give us in an enquiry is accurate, current and yours to give, and that the contact number you supply is one you are entitled to be contacted on.

How we will contact you

By giving us your contact number you consent to us contacting you about your enquiry by phone call, WhatsApp, SMS or email, whichever is most practical.

Messages sent through WhatsApp or any other third-party service are also subject to that provider's terms. We are not responsible for a message that provider fails to deliver.

You can ask us to stop contacting you at any time and we will stop, other than where we must contact you about an existing class or a legal obligation.

Acceptable use

You agree not to:

• Submit false, misleading or impersonating information through any form on this site
• Submit another person's details without their knowledge and consent
• Use the site or its forms to send spam, advertising, or any unlawful, abusive, defamatory or obscene material
• Attempt to gain unauthorised access to the site, its infrastructure, or any connected system
• Probe, scan, or test the vulnerability of the site, or breach or circumvent its security or authentication measures
• Use automated means to scrape, harvest or copy content, tutor information, or contact details from the site
• Interfere with the site's operation, including by overloading it or by introducing malicious code
• Use the site or anything on it for a purpose that competes with us, including compiling a competing directory

We may block access, refuse or withdraw service, and report conduct to the authorities where we reasonably believe these terms have been breached.

Intellectual property

All content on this website, including the Afterkelas name and logo, text, layout, graphics, photographs, video, and the study material published on our blog, is owned by us or licensed to us, and is protected by Malaysian and international copyright and trade-mark law.

You may view this site, and print or download extracts for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, adapt, distribute, or commercially exploit any part of it without our prior written permission.

Tutor names, photographs and university affiliations are published with their permission and remain theirs. Do not reuse them.

If you believe material on this site infringes your rights, write to us at afterkelas@gmail.com with details and we will investigate.

Testimonials, results and academic outcomes

Academic outcomes depend on many things outside our control, including the student's prior knowledge, effort, attendance, and the examination itself. We undertake to teach with care and competence; we do not undertake that a specific grade will follow.

Tutor profiles, university affiliations, student numbers and similar figures are accurate to the best of our knowledge at the time of publication and may change without notice.

Study material on our blog is general educational content. It is not a substitute for the official syllabus, your school's guidance, or advice about your own circumstances, and we do not warrant that it is complete or current for any given examination sitting.

Availability of the site

We aim to keep this website available, but we provide it "as is" and "as available". We do not warrant that it will be uninterrupted, timely, error-free, or free of viruses or other harmful components.

We may change, suspend or withdraw any part of the site, including any page, form or published material, at any time and without notice.

Third-party links and services

This site links to services we do not control, including WhatsApp, our social media profiles, and our tutoring platform at ats.afterkelas.com.

A link is not an endorsement. We are not responsible for the content, availability, or practices of a service we do not operate, and your use of it is governed by that operator's terms.

Limitation of liability

To the fullest extent permitted by Malaysian law, we exclude all warranties, conditions and representations not expressly set out in these terms, whether implied by statute, common law or otherwise.

We are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data, goodwill or anticipated saving, arising out of or in connection with your use of this website, however caused.

Our total liability arising out of or in connection with this website and these terms, whether in contract, tort, negligence, statute or otherwise, is limited to one hundred Malaysian Ringgit (RM100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Liability arising from tuition itself is dealt with in your class agreement and the platform terms, not here.

Indemnity

You agree to indemnify us against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of this website, or your submission of another person's information without their consent.

Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these terms. Please read it before submitting an enquiry.

Changes to these terms

We may revise these terms at any time by updating this page. The effective date at the top shows when they were last revised.

Your continued use of the website after a revision takes effect means you accept the revised terms. Check this page from time to time.

General

Severability

If any provision of these terms is held to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force.

No waiver

If we do not enforce a right under these terms, that is not a waiver of it, and we may enforce it later.

Entire agreement

These terms and the Privacy Policy are the entire agreement between us regarding this website, and replace anything said or written about it before.

Assignment

You may not assign your rights under these terms. We may assign ours to a successor of the business, on notice to you.

Governing law and jurisdiction

These terms and any dispute arising out of or in connection with them, including a non-contractual dispute, are governed by and construed in accordance with the laws of Malaysia.

You and we submit to the exclusive jurisdiction of the courts of Malaysia. Before starting proceedings, please contact us so we can try to resolve the matter directly.
